Service Terms for Businesses

Dernière mise à jour: 2026-10-11

These terms apply to every business that opens an account with Kashuv and runs AI agents through it: a phone agent, a WhatsApp or Telegram agent, a landing page, and any other service we offer (the "Service"). Ticking the box at sign-up, or confirming on the acceptance screen when entering the account area, is acceptance of these terms on behalf of the business; the person accepting confirms they are authorised to bind it. These terms add to the Privacy Policy and the website Terms of Use; where a signed written agreement with the business exists, it prevails in case of conflict. The Hebrew version is the binding one; this is a translation.

1. What the Service does

Kashuv is a system. The business configures its own agents: what they know, what they say, whom they hand enquiries to and when. The agents answer the business's callers in its name, record the enquiries and pass them to the business. Answers are generated automatically by AI models and can be wrong; they do not replace the business's own judgement.

2. The account

Give accurate details and keep them current. The business is responsible for keeping access to the account safe (the email address, the sign-in links sent over WhatsApp) and for everything done through it. If you think someone else has accessed the account, tell us at once.

3. Your content and your customers' content

Everything the business puts into the Service (brief, price lists, answers, photos, instructions to the agent) and everything its callers provide through it (calls, recordings, transcripts, messages, lead details) belongs to the business. The business owns that data and is responsible for it towards its callers. The business grants us a limited permission to process it solely to provide the Service to it: taking calls and messages, transcribing, generating answers, storing, and showing and sending the enquiries to the business. We do not sell this content, do not use one business's content to serve another, and do not share it with anyone other than the infrastructure providers that run the Service for us (telephony, speech recognition and synthesis, language models, storage), and only as far as that requires. Aggregate statistics that identify no business or person (for example call counts, durations and error rates) are used to operate and improve the Service.

4. We do not look at your content

Automated processing by the system is part of the Service. No person on our side reads, listens to or views the content of the business or its callers except: (a) at the business's request, for support, and only as far as the request requires; (b) where needed to protect the security of the Service, stop abuse or fraud, or investigate a suspected breach of these terms; (c) where required by law or by an order of a competent authority. In cases (b) and (c) we will tell the business where the law allows.

5. Your responsibility for use

The business is responsible for using the Service lawfully, including: (a) obtaining from its callers and customers every consent the law requires, including for recording, transcription and processing of their data, and for sending messages or placing outbound calls (including the Israeli Communications Law rules on advertising messages and the Privacy Protection Law); (b) not disabling or hiding the notice the agent gives at the start of a call that it is an automated agent and that the call is recorded; (c) honouring opt-out requests and not contacting anyone who asked not to be contacted; (d) making sure what it teaches the agent is accurate, current and not misleading, including prices, hours, offers and conditions. The business is responsible for the content it provides and for the promises the agent makes based on it.

6. Regulated fields

A business in a regulated field (health, medical and aesthetic treatment, medicines and supplements, legal, financial or insurance advice, and others) is responsible for its agent complying with that field's rules. An agent must not be configured to give a medical diagnosis, personal medical advice, or a recommendation of a prescription drug or dosage, and the agent's answers must not be presented as qualified professional advice. The agent is not an emergency service and does not replace calling emergency services.

7. Prohibited use

Do not use the Service for unlawful activity; harassment, fraud or impersonating another person or body; sending advertising in breach of the law; offensive, discriminatory or infringing content; attempting to bypass the Service's security or limits, overloading it or reverse-engineering it; or any use that may expose us or third parties to harm.

8. Recordings and retention

Calls and conversations with the agents are recorded and transcribed, and callers are told so in the first sentence of the call. Audio recordings are stored encrypted and deleted automatically after 30 days; at the business's request the period can be shortened to 7 days or extended up to 90 days per line. The transcript and call summary, which are the business record of the enquiry, are kept while the account is active so the business can return to them. The business may ask at any time for a specific recording, transcript or enquiry to be deleted. After the account is closed, and at the business's request, we will hand over a copy of its data and delete it within a reasonable time, unless the law requires us to keep it. More in the Privacy Policy.

9. Trial, billing and cancellation

Some services start with a free trial whose length and limits are shown at sign-up. After that the Service is paid according to the plan the business chose at purchase, charged in advance for each billing period through the payment provider. Third-party costs the business contracts for directly (for example Meta conversation fees on the business's own WhatsApp Business account) are borne by the business. You may cancel at any time; cancellation, refunds and consumer rights are governed by the cancellation policy in the website Terms of Use ("Cancellation and refunds"). If a payment is not received we may suspend the Service after notice.

10. Availability and changes

We make reasonable efforts to keep the Service running, but it relies on telecom and infrastructure providers and may suffer faults and interruptions. The Service is provided as is. We may improve, change or discontinue features; a material change for the worse in a paid service will be notified to the business in advance.

11. Intellectual property

The system, software, voices, templates and brand belong to Kashuv or its licensors. The business receives a right to use the Service for its own business purposes while the account is active. We may use suggestions and feedback you send us to improve the Service.

12. Limitation of liability

To the fullest extent permitted by law: we are not liable for indirect, consequential or special loss, loss of profit, loss of customers or enquiries, or loss caused by an agent answer built on what the business taught it. Our total liability to the business, on any ground, is limited to the amount the business paid for the Service in the twelve months before the event giving rise to the claim. Nothing here limits liability that cannot be limited by law.

13. Indemnity

The business will indemnify us against any third-party claim, demand or fine arising from the content it provided, the instructions it gave the agent, a consent it should have obtained and did not, or use of the Service in breach of these terms or the law, provided we notified the business of the claim and allowed it to defend.

14. Suspension and termination

The business may close its account at any time, subject to the cancellation policy. We may suspend an agent or an account, with notice where possible, for prohibited use, a risk to security or to third parties, non-payment, or a demand by a competent authority.

15. Changes to these terms

We may update these terms. A new version will be published on this page with its date, and on the next visit to the account area the business will be asked to accept it before continuing. A business that does not agree to the new version may close its account.

16. Governing law and jurisdiction

These terms and the use of the Service are governed solely by the laws of the State of Israel. The competent courts of Tel Aviv-Jaffa have exclusive jurisdiction over any matter arising from them.
